UK's Biggest Construction Show Bans 'Promo Girls'

COVID-19 Business Interruption Claims Four Years Later: What Have We Learned?

Four and half years ago the COVID-19 pandemic spread around the globe, bringing with it interesting, but challenging, legal problems for construction attorneys. Construction projects ground to a halt. Ever-changing guidance from authorities ranging from the U.S. Department of Labor to local health authorities resulted in a web of evolving obligations for general contractors and subs alike. One of the most closely watched legal questions was the wave of business interruption claims filed by plaintiffs, many of whom owned businesses impacted by government shutdowns. During the opening months of the pandemic, I noted that hundreds of business interruption claims had been filed by insureds across the country. At that time, the only thing certain was that although the outcome remained unknown, virus exclusions were likely to become more likely in the future. Needless to say, much has happened since early 2020. What does the data say about the outcome of business interruption claims? In sum, plaintiffs have had an uphill battle. A helpful resource for analyzing the outcome of business interruption suits is the Covid Coverage Litigation Tracker (“Tracker”), an insurance law analytics tool offered by Penn Carey Law of the University of Pennsylvania. According to its website, “[t]he Covid Coverage Litigation Tracker is a multi-sourced database and dashboard through which to view the unfolding insurance litigation arising out of the pandemic in federal and state courts. Widely cited in briefs, judicial opinions, and the press, the tracker also serves as a proof of concept for new methods to identify, track, and understand emerging case congregations in real time.” Read the court decision

MapLab: Why More Americans Are Moving Toward Wildfire

Climate change is making wildfires more frequent, severe and hard to predict — not to mention more costly, as governments, insurers and local residents pay to pick up the pieces after a blaze. Yet Americans are flocking to areas at high risk for burning, and the pandemic accelerated that trend: During the first year of Covid-19, the number of U.S. households moving into areas with a recent history of wildfire increased 21% over the previous year. Areas without that recent history saw net moves fall by 15%. Those shocking statistics were among the many findings made by my colleague Marie Patino and me in our investigation of recent U.S. migration into the wildland-urban interface, or the edge between highly developed areas and flammable forests and mountains. Between affordability pressures and cultural ideals, our story explores the motivations for why so many people are settling there — in many cases, within the literal footprints of recent wildfires — as well as the staggering cost of this long-term trend. We paired the narrative with rich visuals, including photographs, data visualizations, and maps, with the help of our graphics colleague Jackie Gu. Construction Defect Claims Not Covered

May 10, 2022 — Tred R. Eyerly - Insurance Law Hawaii
The court found that the insured's negligent acts causing damage to only the structure of the home it built were not covered under the CGL policy. Westfield Ins. Co. v. Zaremba Builders II LLC, 2022 U.S. Dist. LEXIS 36189 (N.D. Ill. March 2, 2022). Zaremba contracted to build a house for the Vrdolyak Trust. After completion of the home, the occupants found many problems, including painting defects such as bubbling and peeling, leaving the basement full of water for months, causing damage to ductwork, framing and piping in the house, etc. The Trust sued and Westfield denied a defense. Westfield filed a declaratory judgment action for a ruling that it had no duty to defend or indemnify. On Westfield's motion for summary judgment, the court determined there was no property damage. Property damage included "physical injury to tangible property." When the alleged damage occurred in the course of a construction project, tangible property had to be property outside the scope of the contract for project. Read the court decision
