Time is Money. Unless You’re an Insurance Company

Benjamin Franklin may never have been President but he’s better known than most of them. Not least of all for his pithy quotes on a wide range of subjects:

On personal finance – “A penny saved is a penny earned.”

On education – “Tell me and I forget, teach me and I remember, involve me and I learn.”

On getting real – “In this world nothing can be said to be certain, except death and taxes.”

On guests – “Guests, like fish, begin to smell after three days.”

On lawyers – “A countryman between two lawyers is like a fish between two cats.”

On beer – “In wine there is wisdom, in beer there is freedom, in water there is bacteria.”

But if you were to pick one theme that seems to recur the most in Franklin’s quotes, it would be productivity:

“Time is money.”

“By failing to prepare, you are preparing to fail.”

“Never leave that till tomorrow which you can do today.”

“Early to bed and early to rise, makes a man happy, wealthy and wise.”

But, as the next case, Grebow v. Mercury Insurance Company, Case No. B261172, California Court of Appeals for the Second District (October 21, 2015), illustrates, sometimes the most efficient way of doing things may not necessarily be the most financially prudent way of doing things. Construction Firm Settles Suit Over 2012 Calif. Wildfire

SACRAMENTO, Calif. (AP) — Officials say a construction company and a logging firm have collectively agreed to pay $9 million for damages resulting from a 2012 wildfire that burned more than 1,600 acres of national forest land in Northern California. The U.S. Attorney's office in Sacramento says Monday that the agreement settles a lawsuit brought by the federal government against Kernen Construction and Bundy & Sons Logging. San Francisco Office Secures Defense Verdict in Legal Malpractice Action

San Francisco, Calif. (October 31, 2024) - After a ten-day jury trial in San Francisco Superior Court, Partner Alex Graft recently secured a defense verdict in a legal malpractice action arising out of underlying litigation with the claimants’ homeowners association. The claimants alleged his client attorneys negligently advised them that the terms of the settlement agreement would result in the creation of a so-called independent board of directors for the homeowners association. It did not come to fruition. After the attorneys withdrew, they sued for their outstanding fees, which elicited a cross-complaint alleging malpractice, breach of fiduciary duty, breach of contract and negligent misrepresentation. No Coverage For Construction Defect Under Illinois Law

The court followed precedent in Illinois and upheld the insurer's denial of coverage for construction defects that did not damage other property. Design Concrete Founds., Inc. v. Erie Ins. Prop. & Cas. Co., 2014 Ill. App. Unpub. LEXIS 2684 (Ill Ct. App. Nov. 26, 2014). In 2005, the homeowners contracted with the general contractor to build a home. The general contractor hired Design to do the foundation work. Design performed its work in August 2005. After the work was completed, cracks formed in the foundation, allowing water to enter the basement and an inward shifting of the foundation. The homeowners sued the general contractor and Design. The complaint alleged that Design failed to build the foundation in a workmanlike manner, resulting in the development of cracks in the foundation. Read the court decision

Preventing Common Electrical Injuries on the Jobsite

Despite the overall decrease in electrical workplace fatalities, construction workers remain the most at risk of death from electrical accidents. In 2016, 53% of all fatal electrical injuries were in the construction industry, according to the Bureau of Labor Statistics. Employers can improve their bottom line by implementing prevention strategies to reduce chances of electrical injuries and create a safer, more efficient jobsite. What Are the Most Common Electrical Injuries in Construction? The three types of electrical injuries that occur the most often on construction jobsites are:

1. electrocution (such as electric shock and burns) through unintentional contact with high-voltage lines or equipment;
2. severe burns or death from explosive gases accidentally ignited by electrical equipment; and
3. injuries from falls or from contact with moving equipment after worker experiences a low-voltage electrical shock and can no longer keep balance or physical control of the tools or equipment they have when shocked.

Turmoil Slows Rebuilding of Puerto Rico's Power Grid
