    What Rich Millennials Want in a Luxury Home: 20,000 Square Feet

    February 15, 2018 —
    A new generation of affluent homebuyers powered by a surge in inherited wealth is driving the luxury-home market, demanding larger spaces and fancier finishes, according to a report heralding “the rise of the new aristocracy.” Prospective homebuyers under 50 account for most of those shopping for homes priced at $1 million or more, according to the report. Nearly a quarter of high-net-worth consumers between 25 and 49 said they would look for at least 20,000 square feet when they made their next home purchase; it was just 6 percent for respondents 50 or older. The report is based on a survey of more than 500 consumers with at least $1 million in investable assets, conducted last month on behalf of Luxury Portfolio International, a network of real estate brokerages.     Lewis Brisbois Successfully Concludes Privacy Dispute for Comedian Kathy Griffin Following Calif. Supreme Court Denial of Review

    November 19, 2021 —
    Los Angeles, Calif. (October 18, 2021) - On October 13, 2021, the California Supreme Court declined to review a published, unanimous opinion of the Court of Appeal in favor of comedian Kathy Griffin and her husband, Randy Bick. The plaintiff-appellants claimed Ms. Griffin and Mr. Bick violated their privacy rights by using home security cameras to record “every move and every communication” in the plaintiffs’ private back yard. Ms. Griffin and Mr. Bick maintained that the lawsuit was filed by their neighbors in retaliation after the husband directed what the Court of Appeal described as “an expletive-laden rant” at Ms. Griffin and Mr. Bick. The neighbor's rant was recorded by security cameras and reported in the media, as well as publicized during Ms. Griffin’s performances at the Dolby Theater. In the trial court, Ms. Griffin and Mr. Bick successfully moved for summary adjudication of the plaintiffs’ privacy causes of action. In July 2021, the Court of Appeal affirmed, calling the appellants’ claims “hyperbole.” Read the court decision

    Union Handbilling: When, Where, and Why it is Legal

    November 06, 2018 —
    A few days ago, IBEW Local 98 began began protesting a restaurant owned by professional football player Jahri Evans. The organizers are accusing Evans of violating local construction wage standards and are advertising their dispute with “handbills.” What are handbills? Walking down Fremont Street in Las Vegas is impossible without one or several characters putting a small business card with “questionable” adult entertainment advertisements in your hand. Some will slap papers to your chest, leaving you no choice but to grab the flyers. On a different level, this action occurs on a regular basis by union member. But instead of shady characters pushing questionable entertainment, it is union representatives pushing a dispute with a local employer over working conditions. However, in either case the practice is known as i as handbilling. Read the court decision

    Mediating is Eye Opening

    September 17, 2015 —
    As anyone that reads this construction law blog on any sort of regular basis knows, I am a big advocate for mediation in most cases (construction or otherwise). I took this truly to heard about four years ago when I decided to go through the training and mentorship to become a certified mediator here in Virginia. This training led to many opportunities to act as a mediator in the General District Courts here in Virginia and has recently given me the great privilege of helping parties that were not court referred resolve their disputes. I’ve discussed this first category of mediations at other times here at Musings, but it is the second category that has opened my eyes lately. The non-court referred mediations are those where the parties actively seek out the assistance of a mediator because they, like me, know that more often than not the control and ability to come to some form of negotiated solution (not to mention short circuiting the litigation process in a way that saves money) is a better way to go than to go through the expensive (though as a construction attorney I acknowledge sometimes necessary) process of litigation.     Insurer Wrongfully Denies Coverage When Household Member Fails to Submit to EUO

    May 06, 2024 —
    The court determined that coverage for a loss by fire could not be denied when the insured's son failed to appear for a examination under oath (EUO). Adekola v. Allstate Vehicle & Prop. Ins. Co., 2024 U.S. Dist. LEXIS 27125 (E.D. Pa. Feb. 16, 2024). Plaintiff had a homeowners policy with Allstate. Plaintiff - Michele Adekola - was the named insured under the policy. After the fire, Allstate provided payments for temporary housing. Allstate requested examinations under oath of Plaintiff and her son, Nico. Plaintiff and her son were examined by Zoom. Allstate then sought to examine Plaintiff's other son, Lemmeco, but these efforts were unsuccessful. Allstate then stopped paying for Plaintiff's temporary housing and informed Plaintiff that Lemmeco's failure to participate in an EUO was a material breach of duties under the policy and the breach was prejudicial to Allstate. Allstate further contended that Lemmeco had a duty to submit to an EUO. Read the court decision
