    Washington Builders Right To Repair Current Law Summary:

    Current Law Summary: (SB 5536) The legislature passed a contractor protection bill that reduces contractors' exposure to lawsuits to six years from 12, and gives builders seven "affirmative defenses" to counter defect complaints from homeowners. Claimant must provide notice no later than 45 days before filing action; within 21 days of notice of claim, "construction professional" must serve response; claimant must accept or reject inspection proposal or settlement offer within 30 days; within 14 days following inspection, construction pro must serve written offer to remedy/compromise/settle; claimant can reject all offers; statutes of limitations are tolled until 60 days after period of time during which filing of action is barred under section 3 of the act. This law applies to single-family dwellings and condos.

    Anticipatory Repudiation of a Contract — The Prospective Breach

    July 05, 2021 —
    There are instances where a party can engage in the anticipatory repudiation of their obligations under a contract. In essence, this is basically a party prospectively breaching the contract by repudiating their obligations in the contract. A prospective breach of contract occurs where there is absolute repudiation by one of the parties prior to the time when his performance is due under the terms of the contract. Such a repudiation may be evidenced by words or voluntary acts but the refusal must be distinct, unequivocal, and absolute. Moreover, repudiation can be shown where one party makes additional demands not included in the initial agreement:
    The law is clear that where one party to the contract arbitrarily demands performance not required by the contract and couples this demand with a refusal to further perform unless the demand is met, the party has anticipatorily repudiated the contract, which anticipatory repudiation relieves the non-breaching party of its duty to further perform and creates in it an immediate cause of action for breach of contract. 24 Hr Air Service, Inc. v.     New Jersey School Blames Leaks on Construction Defects, May Sue

    January 28, 2013 —
    The Carlstadt Board of Education recently commissioned a investigation into the water leaks at Carlstadt Public School. The report has not been released in full, but redacted board minutes make reference to "a lack of waterproofing, drainage and clogged or buried weep holes." The investigation is ongoing and the board's business administrator, Pamela Baxley, states that its "ability to recover damages in potential litigation may be impacted should this information be released prior to the conclusion of their investigation." The building in question opened in April 2007, and the leaking began that October. The contractor has fixed leaks, but further leaks have occurred. Read the court decision

    Can We Compel Insurers To Cover Construction Defect in General Liability Policies?

    Recently, I read an article on Engineering News-Record that outlines a remarkable movement by as many as four states, to mandate coverage of construction defects in contractor general liability insurance policies. Say what? Is this a reality? What will become of affordable insurance?

    Commercial General Liability insurance, or CGL, is your basic liability insurance. Every contractor doing business in the State of Washington, and most likely those abroad, has this insurance. Contractors buy this insurance to protect them from unforeseen liabilities arising from their negligence - and right now it’s reasonably affordable.

    Why is it so affordable in such a risk-heavy industry? Because CGL policies significantly limit the scope of their coverage. Coverage is generally afforded for damages resulting from negligence (The roofer put a hammer through the drywall contractor’s wall) or which resulted from your defective construction (the roof leaked and flooded the rest of the house). But, that coverage does not include replacement of your faulty construction (the contents of the home might be protected by your leaky roof - the leaky roof itself is not).

    The debate over coverage typically stems from the definition of “occurrence,” a term used to describe the event from which coverage arises, “resulting loss,” a term used to describe the type of loss covered.

    Contractor Sues Golden Gate Bridge District Over Suicide Net Project

    December 18, 2022 —
    The project to install a suicide-deterrence net and perform other upgrades on the Golden Gate Bridge in San Francisco now is expected to complete five years late and cost more than double the original contract price, its contractors say. The joint venture leading the project filed a breach-of-contract complaint against the agency that manages the bridge seeking $195 million in damages, while the agency counters that delays were caused by changes in the contractor’s ownership.     Contractor Sues Yelp Reviewer for Defamation

    February 05, 2014 —
    Contractor Christopher Dietz sued Jane Perez, a Virginia homeowner who “wrote a pair of scathing reviews of his services” on Yelp, according to Yahoo Finance. Dietz sued for “defamation and” sought “$750,000 in damages.” The Fairfax, Virginia jury did find the reviews to be defamatory, but they also “found that Dietz had defamed her as well when he responded to her negative reviews with accusations of his own.” The jury decided that “neither deserved to recoup damages.” Read the court decision

    Weyerhaeuser Leaving Home Building Business

    November 13, 2013 —
    The Washington-based timber giant, Weyerhaeuser, has announced that has sold off its homebuilding business. The division went by the name of WRECO (Weyerhaeuser Real Estate Company) and comprised five home builders, Maracay Homes, Pardee Homes, Quadrant Homes, Trendmaker Homes, and Winchester Homes. The division was bought by TRI Pointe Homes for about $2.7 billion of which $700 million was paid in cash. Weyerhaeuser intends to focus on their core business of timber products.     Hudson River PCB Cleanup Lands Back in Court

    As it previously had warned, New York state on Aug. 21 filed a federal lawsuit against the U.S. Environmental Protection Agency seeking to reverse its certification that General Electric Co.'s removal of PCBs from the Hudson River was complete, despite the agency’s five-year review finding that the cleanup was not adequate to protect human health and the environment.
