Recent Developments with California’s Right to Repair Act
June 11, 2014 —
Beverley BevenFlorez-CDJ STAFFIn Lexology, Amy Kuo Alexander of Gordon Rees Scully Mansukhani, LLP analyzed recent decisions involving California’s Right to Repair Act, SB 800. According to Alexander, “SB 800, applies to all new residential construction sold after January 1, 2003” and “[i]t establishes a process to resolve certain construction defect claims prior to the filing of any lawsuit by a homeowner of new residential construction.”
Alexander’s three main discussion points include “SB 800 is Not the Exclusive Remedy,” “Notice Requirements to Builder Under SB 800,” and “Parties Can Opt Out of SB 800 to Adopt Their Own Prelitigation Procedure So Long as the Terms Are Not Unconscionable.”

The Firm Hits the 9 Year Mark!
July 22, 2019 —
Christopher G. Hill - Construction Law MusingsIt was 9 years ago today that I announced the formation and start of my solo practice, The Law Office of Christopher G. Hill, PC. Back then, my children were in elementary and middle school. Now I have two college students, one at Appalachian State University (with a budding photography talent that has provided some photos for this blog (including that on this post)) and the other at West Virginia University, and a rising high school junior. In just the past year I began a tenure on the Section Council Virginia Bar Association Construction and Public Contracts Law section and chair of its Legislative Committee where I assisted in the drafting of the change in the mechanic’s lien form that takes effect today..
I was named to both the Virginia Business Magazine Legal Elite in Construction Law and for a 3rd consecutive year to Virginia Super Lawyers in Construction Litigation. I spoke on how to deal with a DPOR complaint this past November at the 39th Annual Construction Law and Public Contracts seminar (one I highly recommend for any lawyer interested in construction).

Virginia Joins California and Nevada in Passing its Consumer Privacy Act
March 15, 2021 —
Kyle Janecek – Newmeyer DillionCalifornia tends to be on the forefront in consumer privacy laws within the United States. However, there is a growing momentum for other states to join California in legislating consumer privacy rights, as well as pushes for federal legislation. The latest state to join in and pass consumer privacy legislation is Virginia, with its Virginia Consumer Data Protection Act (VCDPA). With Virginia joining the fray, several questions arise, such as how closely does the VCDPA follow California's legislation? How, if at all, does it differ from already-existing legislation? What do businesses need to comply with the VCDPA, if at all?
WHAT IS THE VIRGINIA CONSUMER DATA PROTECTION ACT?
The VCDPA largely mimics elements from its Californian cousins, the California Consumer Privacy Act (CCPA) as modified by the California Privacy Rights Act (CPRA). The main features of the law include: (a) issuing the right to request what information is collected; (b) the right to correct information provided; (c) the right to deletion; (d) providing notice to consumers regarding the collection of their data; and (e) protecting consumer data. Further, the consumer requests, akin to the CCPA, do require verification, and similarly phrased data security practices that rely on how "reasonable" they are, depending on the volume and type of information at issue. Though, the VCDPA does expand on this slightly, requiring "data protection assessments" to determine the security of protected information, how it is shared and used, the benefits in sharing the information and harm resulting from any breaches.

WSHB Ranks No.10 in Law360’s Best of Law Firms for Women
April 28, 2016 —
Beverley BevenFlorez-CDJ STAFFLaw360 recently published the survey findings and listed the “100 Best Law Firms for Female Attorneys,” and
Wood Smith Henning & Berman LLP (WSHB) ranked tenth.
“I was thrilled to help spearhead a recruitment committee to attract and retain female lawyer talent,” Victoria Ersoff, the first named partner at WSHB, stated. “Long before it was fashionable, the leaders at WSHB recognized that in order to retain first-class lawyers, they need to provide them with opportunities to balance their work and personal life.”
Janice Michaels, managing partner of WSHB’s Las Vegas office, praised the firm for treating all attorneys equally: “Female lawyers at WSHB are on equal footing with their male counterparts, whether it’s trial experience, mentoring or expanding professional opportunities. It is a great environment to learn and grow without the impediment of a glass-ceiling.”
